If we refinance a Home Equity loan into a non-Home Equity loan, does the non-owner spouse have to sign the Notice Concerning Refinance of Existing Home Equity Loan to Non-Home Equity Loan Under Section 50(f)(2), Article XVI, Texas Constitution twelve days before closing?

If the spouse was required to sign, and didn't, what is the cure for this?
