We had a State Govt check deposited at our Bank several months ago. It came back returned recently. A late return claim was submitted. This claim came back again as the late return claim being ineligible per Reg CC 229.34. I see a small section about return check warranties not applying at (d)(2) of that section, but not sure what applies from this section.

I do see that expeditious return does not apply at section 229.42 - Exclusions, I'm just not sure what I am missing in 229.34.

It was returned as duplicate. It was deposited via mobile deposit (and bore restrictive endorsement to our institution.)
