Can we charge a customer the Docusign fee? We have many loan customers who prefer to sign through Docusign simply so they don't have to make a trip into the bank. Are we able to pass that fee along to them? Would it be considered a FC? We do not require they sign through Docusign, nor would we retain any of the fee?

How about for deposit accounts? Are we able to pass the Docusign fee along to deposit customers?

Such a fee is not addressed in the MN Statutes. It might depend on what they are signing and why. Most loan disclosures do not require a signature, so I would think it would be treated as a finance charge, if you chose to pass the fee along to the customer.

As far as deposit accounts, what are you having them sign? You would not gather a signature specimen using an electronic signature and no deposit disclosures require a signature.
