When states require judicial residential foreclosures would you consider that an internal control/risk mitigation when it comes to mortgage servicing?

Our risk assessment has always reflected yes since nothing can happen without court approval, but I'm receiving pushback from an examiner who is looking at the RA. (I guess it's a good sign when they are nitpicking the risk assessment and have nothing else to criticize)

I would see it as a control, as you said, you really cannot do anything unless it is blessed by the courts. So, outside of the examiner just blasting off a personal opinion, what was the reasoning that they gave for the disagreement?
