One of our new branches asked me if the public official fee must be included in the "Fed Box" on the TIL no matter who paid the fee? At her last bank it was required. Is there commentary on this issue or is it just something that was a regulator's idea?

without looking anything up...my recollection is you disclose it in the FED box to keep from including in finance charges.

226.18 requires the disclosure of fees to public officials. And tresaj is correct that 226.4(e) allows you to itemize this and some other charges to avoid having it considered a FC.

See the Commentary to 226.18(o). No special format is required and this disclosure may appear apart from the other disclosures, even on a different form, such as the HUD, or on a dealer invoice.
