Can you deduct from a customer's account a fee for processing a tax levy or garnishment?

Yes, but sure to get your fee first, before you levy the remainder of the monies! We take our $50 fee and then apply the levy amount!

Our lawyer told us we could pull the bank's fee first and then the levy...........? Do you think this would vary by state?

I know when we discussed it in Texas it was a matter of paying them first, and the bank second.

For an IRS levy, a bank fee cannot be deducted first if the entire IRS levy is not satisfied.

We deduct the fees before sending the funds especially on the garnishments. In the garnishments, the bank has a fee plus any attorney fees which both fees are deducted. In our banking area the fees range in the $200.00 or more.

Check with your state banking association. My state limits garnishment fees to $10.00.
