Our bank had a request from a business owner (car dealer) for a copy of the 4789 in order to file a CTR on their customer who gave them over $10,000 in cash to purchase a car. Obviously, this is not a form for businesses other than banks to complete. But, is there a requirement for them to file a CTR and if so, what form should they use?

For anyone wondering the answer, yes, "each person engaged in a trade or business who, in the course of that trade or business, receives more than $10,000 in cash in one transaction or in two or more related transactions, must file Form 8300."

I finally found my answer on Fincen's website. The correct form to use is Form 8300 - Report of Cash Payments Over $10,000 Received in a Trade or Business.

Yes, businesses such as auto dealerships must file a CTR, but the form they use is FinCEN 8300. Try the link, above. If it doesn't work, go to FinCEN's website under Regulatory information.

The rules for non-banks are worse. The car dealer is supposed to keep track of all cash over the course of a year by customer and report once that customer hits $10,000 in total. Not just a transaction basis.

If the dealer is asking the bank for the form I suspect they really don't know the rules. Be careful you don't become the adviser to the dealer.

Good points, Steve. The customer might be able to get some guidance from any of the auto dealers' assns to which it belongs.

Well - you COULD tell the dealer to be thankful they not also subject to CRA, HMDA or RESPA!
