I know that in SC you must give the borrower the opportunity to choose their attorney and insurance agency. If you offer to pay the closing costs on a loan if they use an attorney the bank provides, must you have the borrower sign additional documents that says they have been given the choice but they chose to take advantage of the special program by using an attorney participating in the program chosen by the institution at to no cost to them?

We have the borrower sign the preference statement with the name of the attorney. We don't have any additional disclosure even though the bank may pay for the attorney instead of the borrower.

I understand that the administrator of the S.C. Consumer Credit Code has provided a form for this. Does anyone know where I can get a copy?
