We have a customer who moved from our state to another state. We have a UCC filed in our state and know we need to file in the customer's new state, however we don't want to lose our position. Would a transition filing work for this? Also, do I understand transition filings will no longer be effective after 6/30/06? Thanks!

Transitioning the existing UCC to the new state means you retain your original filing date, if transitioned prior to the filing expiration date. You would not want to file a new UCC because then the effective date is the date of the new UCC filing.

As to transitioning a UCC after 2006, that will be a moot point at that date since all UCC filings would have to have been transition by then. Any UCC you have in a county that needs to be transitioned should have been done by that drop dead date or it will be expired as you cannot continue that UCC at the county level, unless your filing on minerals, timber, etc..
