If your state law allows for imaging, and you are happy with the evidentiary concerns, etc. is there any obligation any knows of under Federal law, rules or regs to require that the Bank allow opt outs from imaging or is this the marketing choice of the Bank? Example, if 99 customers are willing to accept imaging and 1 says "hey--no way", can you force imaging (or close) the customer who does not like imaging or must you allow this person the option to opt-out (assuming nothing under state law) and send the checks monthly. My understanding is there is no forced opt-out under Federal law and this is the Bank's decision. Thanks for reading this and helping. Snowcat.

I think it's up to the bank. My former employer returned checks on very few accounts and I don't think my current employer returns any checks to customers in their statements. It's just a marketing/PR issue.

I have never heard of anything. When we launched it was an all or nothing proposition and I've heard from others they did the same.

Your state law may have a requirement that you provide the customer with some number of check copies if you truncate w/o images, at no charge, per month or per statement. Those don't necessarily need to be originals though. At least in TX.

Our checking accounts default to image statements. If the customer wants the checks back (depending on the type of dda) they either pay a nominal monthly fee for us to return or the acct type will allow them to get the checks returned for free. As I recall when we rolled this out a few years ago, we mailed notices and told everyone we were switching to image statements and gave them the option to pay the $1 per month to continue receiving the checks back.
