Our computer system vendor is providing us with online disclosures for HOEPA covered loans. Not only have they given us the disclosure that is to be given 3 days prior to closing, but also they have given us a note addendum and a security instrument rider. If a loan is subject to HOEPA must you amend the note and mortgage to say so?

If you are talking about Bankers Systems documents, the addendum and rider ammend wording in the note and/or mortgage about default provisions that conflict with HOEPA. You would need to ammend these documents to be in compliance with the regulation. You can get in touch with your representative for more information.
