Question about fee test. Clarify for me the fee test $510 or 8% whichever is greater. If I have a loan for $25,000 and total fees are $1850.00 ($1850.00 X 100 divided by $25,000 is 7.42% which is under the 8% mark). Would this be a HOEPA loan? The $1850 is greater than $510.00, but less than 8% of loan balance. I have gotten myself confused

Your calculations are a bit off but it looks like you do not have a HOEPA covered loan, but just barely!
You forgot to deduct your fees from your loan amount to come up with the amount financed. Then the calculation is total fees/amount financed. If you have given us the correct infomation you come out at 7.99%, just below the 8% threshold.

If your loan amount is less than $6,375 then your fees can not exceed $510. If your loan amount is greater than $6,375. Then your fees can not exceed 8%. At the loan amount $6,375 the $510 amount is 8%, so that is your breakpoint.
