I'm trying to get a handle on existing/new requirements and the effective date to transition to the new law requirements:
(1) We have an order from the FCC delaying "opt in" for unsolicited faxes sent to established business relationships (EBRs).
(2) We have a law that changes unsolicited fax requirements for those with an established business relationship (EBRs). The law will require an opt out method. I don't think the old requirements did require an opt out method for EBRs.
(3) We will have regulations from FCC in several months.

So....Should we have the "new law requirements" to house EBRs' opt outs in place now or when regs are issued?

Sky Diver: Yes, that was my question. Our fax sheets already have the required information on them. It is the written permission to send the fax to an EBR in the first place that I am concerned about.

bump - good question. Do we have to have the opt out in place now or when regs are issued? There does not seem to be alot of information regarding this issue.....

The best advice I could provide would be that the law is in effect. Regs, enforced by various agencies and in this case the FCC, are not out yet. I would follow the require mets under the law as the regs may not be issued for many, many months.

For those of you who have placed an opt-out on the first page of the fax message, what are you using for a 24/7 means for the recipient to request removal from the fax distribution?

In the last update on this topic, in reference to the existing relationship, is it saying you now dont need an authorization by the deadline to continue faxing with an established relationship?

I disagree. The definition of established business relationship also includes those who inquire or apply for a product/service. 47 CFR 64.1200

You have to have a fax number and telephone number...plus whatever you use for "opt out" mechanism must be cost free and available 24/7. Law.....47 USC 227(b)(2)(E)(iv)

Clink on the link. Then remove all of the data in the url after gov/. Then go to the search function and type in S714.

Proposal info from the FCC. I looked at the FCC site, and I don't see a draft proposal. I assume (dangerous term) that they just want comments based on the text of the document linked above.

Is there any new information on this issue? The Act directs the FCC to issue regulations to implement the amendments no later than April 5, 2006. To my knowledge no guidance has been issued. I want to be proactive, but would like to see some kind of guidance.
