We have a loan past due at this time. The loan was secured by a real estate mortgage(2nd at time of loan). Foreclosure papers received by us in Dec of 2004. Customer stated at that time would not let this happen. Payments were made on loan with us every month until June 2005. The real estate has been sold thru foreclosure. When we send the Cure Notice, do we also send the home ownership counseling notice? We still have a mortgage on file but it is no longer valid since ownership of home has changed due to foreclosure.

I would go ahead and use the 30 day w/ junk mail approach. The need for a cure is probably driven by the contract's acceration clause but I would check out the note to see how many ways they defaulted.

Is there any chance you will get paid on this deal? Is it worth the bother? (Expense.) You have unsecured debt with a homeless person. Best of luck.
