I've searched the Indiana Code to no avail, but am hoping someone else may know where to find this info. Is there a section of the Code, or are there any court decisions, that define when a mobile home is considered a fixture to real estate rather than titled personal property?

A long time ago an attorney told me that a mobile home became titled real estate when the mobile home became affixed to the land and the land and mobile home were owned by the same person. Sorry, but I don't have a cite for Indiana Code or any court cases.

Lee, you may find this in the UCC, but not sure.

How we look at it is how it's being taxed. If it is being taxed separately then we of course treat it as personal and titled property. If it's included with the land assessment then we consider it a fixture. We always require a copy of the tax statement to see how it is being taxed.
