Chapter 47-10.2-01 defines "Excess Amount" as any amount received in an escrow account during a calendar year in excess of $300 plus the amount necessary to pay real estate taxes, special assessments, and insurance premiums during that calendar year.

My question is this: Is the escrow cushion included in this $300 or is the $300 over and above the cushion?

I finally received an answer from North Dakota on this. The $300 is the cushion.
