Can a husband and wife be a sole proprietorship in PA?

Sole proprietor means one. A husband and wife can be partners but only one can be the proprietor. Usually use the SSN of the proprietor or the EIN of the businesses. IE John Joe, DBA as Joes auto sales.

You may need to ask your legal counsel this one. Our understanding is that the Commonwealth does recognize a husband and wife sole proprietorship.

All the classes and seminars that I have been to specifically teach that "a financial institution open only open sole proprietorship accounts showing more than one owner only on the advise of counsel who should research is issue" Good luck on getting the okay from and counsel on this. Also what we have been told is hus and wife is a partnership or some other entity in PA. So until we are advise by legal counsel otherwise, we will not open sole prop with hus and wife. Check with your legal counsel.
