Regarding the Ohio SCRA, OH HB 456, Sec. 1343.031, effective 5/18/05, does Ohio's 6% per annum apply to mortgages? Ohio's 6% per annum is different from the federal SCRA as it appears that it applies to contracts entered into before and after commencement of active duty.

On the other hand, it appears that this section of provision of the Ohio SCRA may only apply to debts arising from the sale of services or goods and does not appear to apply to mortgage loans at all.

I think the revision to 1343.031 defining "obligation" as a retail installment sales contract for the purchase of goods or services pretty well excludes what most of us think of when we think of mortgages. Goods and services usually means personal/household goods and services, not real estate.
