According to NACHA operating rules (bear with me, I'm new to this), we must give notice to our commercial customers when they receive an ach credit. However, we can give a prior notice(I'm assuming at account opening) which will override this responsibility for notification every time an item is posted. What wording do we use and on what account opening document do some of you use to give prior notification? I am really having a hard time with all of these ACH rules and appreciate any help you can give me.

I am posting again to see if anyone would reply. Should I assume that most banks review their ACH entries daily to send out notices to their commercial customers?

We give the notice in our rules and regs booklet given at time of account opening. It states for preauthorized credits "If you have arranged to have direct deposits made to your account at least once every 60 days form the same person or company, you may contact us to find out whether the transfer was made." Is this what you are looking for?

We sent out UCC4A notices to our business customers and now only give new customers the notice. We ordered them from our ACH Regional Payment Association. (For a big chunk of the country, that is MPX in Kansas City).

The notice covers provisional payment, notice of receipt of entry and choice of law.

In the Notice of Receipt of Entry section it says "Under the operating rules of the National Automated Clearing House Association, which are applicable to ACH transactions involving your account, we are not required to give next day notice to you of receipt of an ACH item and we will not do so. However, we will continue to notify you of the receipt of payments in the periodic statement we provide to you."

I hope this helps.
