Individual has just purchased a mobile home which will be her principal dwelling but has not moved in as yet. Heat/air unit must be replaced immediately before moving in. Additional loan to be made to cover this expense. ROR required?

I would say no because it is a purchase not a refinance. I am not as sure about the 2nd loan for improvement to the furnace. Someone else will weigh in on that one for you.

The first loan is not subject to rescission as it is a RMT, the second loan (as described) is. See the Commentary to 226.23(f)(3).

Thought so but wanted to double check since my lender disagreed with me. The lender thought that as long as she had not moved into the house ROR didn't apply. Thanks for replying.
