And by the way, TAMU trademarked the 12th Man in the early 90s, well after it was being used in Seattle (circa 1984). What is next? Are you guys going to go after Stanford basketball for making use of the "6th Man".

Since you are a trademark expert, why don't you look up and see if we have a trademark on the phrase "6th Man" or not. I do not believe we do, therefore it would be pretty foolish on our part to do that.

Reference the terms "same or similar mark" in the definition of trademark infringement.

It's not. We never asked Seattle for any part of any proceeds from any sale. We asked them to stop using OUR trademark. Since Seattle is making this more difficult than it should be, I would not rule out us going after their profits.

Ron, Rainman, Bengals Fan, and everyone else, I enjoyed it. Neither of us are going to budge so I guess we should all set back and let the courts decide. I believe we went to court today, but I have not heard of any ruling. If you hear, let me know. Thanks again and I enjoyed it, although Ron does get under my skin sometimes.

Was anyone of this? If the courts rule against A&M, it's going to open the door for every other trademark phrase!

Ron didn't even participate in this thread. Texas Boy, you can PM him/me if you upset with him/me, okay?

Oh sorry, Ron did make another comment here when he said that the anon that was arguing with you, TB, didn't think that the other anon's prose was from a good-looking enough person.

A couple of comments had the "look and feel" (smell?) of Ron. If Ron would sign Ron's comments once in a while, we could all be more certain of which are Ron's and which are not Ron's! What does Ron say to that, Ron?

My apologies to you Ron. The deal is everyone else thought it was you and the sorry anon wasn't denying it. Once again, I apologize!

Uhhh. Hey Beavis, pull my finger?

I guess i should stick to the third person but i was made fun of before for identifying myself in that way; presumably because i am arrogant about being right all the time )

It would be like 9/11 times a million.

Did this just turn into a thread about Team America? Awesome!

There are so many lines I want to quote, but sadly, I can’t.

Money was never an issue. We simply wrote them a letter requesting the Seahawks to stop using our trademark. They refused and now we are going to court. Besides, A&M is was one of the richest public universities in the country. Our alumni recognizes the "arms race" in college football and have been very considerate in their donations.

Quote:

Rainman:
Maybe you're right, but I remain unconvinced. I would bet that the lawsuit will result in one of two outcomes:

1) Hawks pay A&M a small (in NFL terms) but still significant (in NCAA terms) payment to dismiss the case and give the Hawks a license to use the term in perpetuity.

Seahawks and A&M reach deal on 12th man phrase
Seahawks, A&M settle '12th Man' flap

Texas Boy, No word on the amount yet, but I'd say that Rainman was closer. A&M was willing to sell out for the money.
