Does anyone have a backgrounder or bullet point summation of the unique Texas Home Equity Loan Requirements?

I have a little training document that I use for our lenders. Send an email address and I'll share.

Texas Bankers' Assoc. has also prepared a useful summary, which you can find here:

I would be most appreciative if you could share your wisdom with me. It seems that consistent straight answers on Texas have been elusive.

This "useful summary" is out of date!

Peter, I would be happy to, but before I do - I'd like Z to let me know what's out of date on the TBA stuff so I can make sure mine is up to date. I think it is, but you never know!

Mostly it is missing the latest court cases on home equity. It is also missing an opinion letter issued jointly by the DOB, OCCC, TDSL, and TCUD--the letter addresses modifications. It also does not discuss the 2001 legislative session, but nothing home equity related really happened. The information in the "Update" actually talks about the legislative agenda for the 2001 session. They have no information about the 2003 session.

I don't think any of the material has been updated in 2 years. You should call TBA and ask them when they will update it. I don't think that the lack of updating is intentional--I suspect it has just been neglected in the turnover of attorneys. In the last 5 years, TBA has had 7 different attorneys in the 3 attorney positions.

Thanks, Z! Peter - the document is on it's way to you. My list isn't that complex - it's just a bullet point primer on HE's, so it appears to be up to date.
