This question is for lenders in states whose high cost laws exclude attorneys' fees from the definition of points and fees if the borrower has the right to select the attorney. Speaking of the HUD-1, what attorneys' fees does this exclude--those on line 1107? What about lenders that have decided to treat line 1107 fees as finance charges? Would you go ahead and include line 1107 fees in your points and fees calculation for the same reason you treat them as a finance charge?
