Besides poor judgement by a teller, what else do you make of this scenario for a CTR? Customer presents US Treasury check in the amount of 15,000.00 payble to JOHN & JILL DOE. John comes to bank and cashes it. Based on how we handled it the CTR is on the behalf of and conducted by JOHN DOE. If it was on-us check from their joint account I know that JILL DOE would not be included but in this case she was actually one of the payees and endorsers of the check.

If Jane was not present at the time the check was cashed, then you only report John.

Since the check is payable to both parties, I would indicate that both parties benefited from the check, and John conducted the transaction.

I would report on John. You have no way of knowing if Jane received any of the cash.

No, Jane would have signed the check over to John. You do not know if Jane is benefiting or not. It is just like John cashing a check against an account he holds jointly with Jane. You would not report jane as benefiting if John cashed a check.

On the flip side, Both benefit from deposits, so you would report both.

Was the check actually paid over to John by Jill? I rarely see a check properly endorsed in these situations.

As the situation wasn't handled properly, you're never going to find any official guidance on how the form should be completed. When in doubt, give them the maximum possible about of information: John & Jill.
