Per the OFCCP regulations:
An Internet Applicant is defined as an individual who satisfies the following four criteria:
The individual submits an expression of interest in employment through the Internet or related electronic data technologies;
The contractor considers the individual for employment in a particular position;
The individual's expression of interest indicates the individual possesses the basic qualifications for the position; and,
The individual at no point in the contractor's selection process prior to receiving an offer of employment from the contractor, removes himself or herself from further consideration or otherwise indicates that he or she is no longer interested in the position.
The key here is that all four parts of the test must be met in order to consider the person an applicant. If the employer does not consider the individual for a particular position, then the person is not considered an applicant, because the person failed that part of the test. In addition, if the individual does not specify interest in a particular position, then he/she also fails that part of the test and should not be considered an applicant. This then eliminates unsolicited resumes through the internet, unless they specify interest in a known open position. But then again the employer must consider them for the position to satisfy the test criteria.
