A complaince officer at a local FI told me that the FACT Act now allows for law enforcement to obtain some financial records of customers without a subpoena. I cannot locate this provision in my copy of the FACT Act?? Is any one else aware of this? If so, can someone please post a link.

Try looking at 609(e) re identity theft and consumers right to request certain records in certain circumstances.

I think Section 627 [1681v] is what you are looking for re: supplying reports to the Gov for counterintelligence without a court order. Under 627 a written certification is required. Section 626 deals with the FBI and court orders, etc.

I think those sections are directed to the bureaus not the FIs
