Are Notary Publics in New York allowed to notarize documents for family members or is it prohibited?

I don't know if it's prohibited, but it's definitely not recommended (especially if the notary has the same last name as the person they are notarizing for). Why would you want to give the impression of a conflict of interest? I would just find another notary.

We have been presented with a Trust Document that was notarized by the son of the Grantor in 2000. The son/notary is also a named Successor Trustee and Beneficiary.

In Florida the laws are very clear that notarizing documents for family members is a prohibited act. Is there a reference point or notary handbook that you could direct me to for clarification on NY Law regarding this subject?

I appreciate your help!

Go here: http://www.dos.state.ny.us/lcns/lawbooks/notary.html

Look under Notary public—disqualifications and Interest as a disqualification.

While I could find nothing specifically prohibiting notarization of a document for a relative, he clearly is an interested party.

As long as you hold no interest in the document being notarized (beneficiary/trustee etc.) it is allowed.
