where can I find a link to the act,, I understand a bank has to reduce the rate to 6% on their consumer loans and has certain repo/foreclosure issues but does it also indicate we can not charge an NSF fee when their check is returned...

no,,we have overdraft protection but it is not a line of credit,,

I am at a public terminal so my resources (time) is limited. But this is a fee, not interest and is not tied to a loan. There is also the possible question if the check was written before or after activation and paid or returned. But my guess is you are OK to charge it. I wouldn't sweat over it and if it is one, would refund it as a gesture beforer I'd put a lot of research into it.
