Would anyone be able to point me in the direction of locating information which supports the requirement (as stated in the NYS ATM Report Year End December 31, 2006) that each banking institution must submit to the Banking Department a copy of the script wording appearing on the ATM screen or printed by the ATM. It appears that perhaps this went into effect in 1999? Perhaps added by Chapter 455, laws of 1999 - I am unable to locate any information on this. Any help would be appreciated.

Sorry Starter, I originally misread your question. I think you're looking for General Business Law sec.399-y. IT was referenced in the 2008 NYS Annaul ATM Safety Report dated Jan.'09.

I'm having trouble this morning accessing NYS-GBL. When I can get in, I'll take a look at 399yy. I'm curious now too. Not sure if it means we have to produce the text during an exam, or actually send it in to the NYSBD annually.

I don't see anything in 399-y re: reporting to NYSBD, although they do continue to state that in the Annual ATM Safety Report. I've got a call in to the NYSBD. I'll let you know next week what I find out.

OK - I got the definitive answer! GBL399y does NOT require annual reporting to NYSBD re: the ATM screen text for fee disclosures. This was a one-time requirement when the law was passed. The NYSBD rep I spoke with was surprised to hear that this wording was appearing in the Department's Annual ATM Safety Report. It must have been carried forward in the annual report since the law first went into effect. Case closed.
