Our trust department (part of the Bank) wants to advertise our retirement plan services (employee benefits, defined benefit plans, etc.) to business owners and managers of retirement plans. The ads are quite generic, but I'm wondering if there are any advertising requirements that need to be met.

I appreciate your help and I thank you in advance for your time.

This ads need the disclosures that say "Not FDIC Insured, May Lose Value, Not Bank Guaranteed" (I think that is the correct verbiage without looking it up). Also they cannot be in the same place as products insured by FDIC. It is hard to find a place to put these ads in branches.

These displays are specifically addressed to business owners and managers of retirement plans - they are not consumer oriented. In addition, the ads address our retirement plan services, rather than investment products. Does that change your answer?

I'm replying to my own post to bump it back to the top - in hopes of getting some other thoughts on this. I need to get back to our marketing folks soon and I'm still not sure I need the NDIP disclosures in this case.

If the retirment services are being offered by the bank as opposed to a subsidiary of the bank or an affiliate and the advertising is promoting the services and not the investment of plan assets in specific funds, products, etc., they I don't believe the disclosures are necessary.

In fact, a portion of the assets may (emphasis on may) be protected by FDIC insurance. So to claim that they are not FDIC insured could be inaccurate.
