Husband and wife apply for a loan. Husband is only one listed on the deed. This is the primary residence for the wife. Does the wife have the right to rescind? Thank you!

I believe this may depend on what state the property is located. Some states have dower rights for both spouses - Kentucky is one of those states. However, Indiana is not. You might want to post this in the section for your state.

In general, the regulation only extends rescission rights to owners whose principal dwelling is held for security and any rights to borrowers/non-owners could be a state law? TY!
