We have a demand deposit account set up as a UTMA account, the custodian is requesting a debit/check card. The child is 4 years old. We have always refused in the past but are being ask to reevaluate our decision. Is there a law against doing this? It looks like the checks being written are for everyday expenses. Can someone point me to a reference?

Hope those everyday expenses are for the child! If it were me, I wouldn't do it!

Some of them could be argued they are, but checks to BeautyCo?? don't think so. Thanks for your input.

Does anyone allow the money to stay in the account until the minor reaches the age of 21? If so, how do you indicate that on the account? Do you have a form the custodian signs to indicate this? Any help would be appreciated.

Generally, assets held in an UTMA account must be transferred to the minor upon reaching age 18; but, Oklahoma law (58 O.S. 1221) permits the delay of such transfer to a specified time after the minor reaches age 18, but not later than when the minor reaches age 21. Note, however, this delay must be specified at the time of the original transfer of assets into the UTMA account.

Does anyone know if in Oklahoma we indicate the custodian as well as a successor custodian on the signature card agreement?
