Has anyone had any experience with Emancipated Minors? I have a branch manger who has opened an account for a 16 year old who is an emancipated minor (we usually require that a parent or guardian be a joint account owner for minors to have an account). Is the emanciapted minor viewed as an adult under the law and able to enter into a legally binding contract etc?

Many years ago, my younger sister was deemed emancipated when our sole surviving parent died. However, the ramifications of what that meant legally were only spelled out for me as far as my capacity as executor, so I'm not sure what it means in terms of banking law.

Thanks. According to the link they do not have the same contract liability as an adult and now he has deposited a large credit card check (not his cc account)!!!

Ann - Was this stated in the section for your specific county? I didn't find it in the general fact sheet.

I found it on the first page under Meaning and Process of Emancipation . "Further, emancipated minors' signatures on contracts (like leases) are not binding in the same way as those of adults."
