Effective 1/3/2002, Texas finance code rule 11.307 wil require a new notice that must be included with GLB privacy disclosures, posted on the FI's website and displayed conspicuously whereever face-to-face business is conducted. This notice gives consumers information on how to file complaints with the Texas Dept of Banking.

Does anyone have a sample, or know of a website that has one?

This is not applicable to national banks.

Here is text from Jack Burkett's (counsel, IBAT) e-mail on this. I don't know that it is the answer, but it should get you on your way.

"7 TAC 11.37 is not on the Banking Department Website. However, you can go to the Finance Commission Website, www.fc.state.tx.us, and click on the agenda for the December 14 meeting of the Finance Commission and then click on Banking Department Matters. This brings up a huge PDF file. If you scroll down to page 169 of the agenda (page 108 of 117 on the PDF file), you will find the rule as adopted by the Finance Commission."

Here is the information that we got from our attorney on Friday.

"FI Name" is chartered under the laws of the State of Texas and by state law is subject to regulatory oversight by the Texas Department of Banking. Any consumer wishing to file a complaint against "FI name" should contact the Texas Department of Banking through one of the means indicated below:

elampman: Bankers Systems has a form for this requirement that can be used as an insert with current privacy disclosures: form PRIV-INS-TX. The language will be included in future privacy disclosures prepared by Bankers Systems.

Thanks, Ted. We use JHA's platform system, which also uses Bankers Systems laser forms, and we're adding it to our new account disclosures.
