We are a small bank with under 300 shareholders of record.. we maintain a shareholder list, process sales & purchases of our shares etc... are we required to send annual privacy mailing?

IMO, shareholders are owners, not customers, and are therefore not subject to the annual privacy mailing. That said, I would advise giving them the right to opt-out should you start selling their information for marketing purposes.

As a result of their being shareholders? No.
