For attorney and insurance preference disclosures, how far in advance of closing do we have to give these disclosures? Do they have to sign a paper disclosure, or can the disclosure be given orally?

These disclosures are required to be given within 3 business days from date of application. They have to be in writing, but I assume if you complied with E-SIGN, you could provide them electronically.

This forum is going to be as good a resource as most any other I could refer you to. Most of the issues you are going to deal with in terms of SC law are within the SC Consumer Protection Code. In that regard, any legal advice I need on SCCPC, I usually contact John Moore, an attorney with Nelson, Mullins, Riley & Scarborough. John is also the general counsel for the SC Bankers Association, and is as knowledgeable on the SCCPC as anyone I know. Also, the SC Bar has a publication on the SC Consumer Protection Code - Text with Comments available here - it's a good publication and the notes help a lot with clarification. It's a little out of date (2001), but the newer sections of law are available online at http://www.lpitr.state.sc.us/code/statmast.htm.

The code says "If a creditor uses a preference notice form substantially similar to a form distributed by the administrator, the form is in compliance with this section."

Any idea where that form is?
