OK - I found the IL Financial Institutions Electronic Documents and Digital Signature Act 205 ILCS 705.
This appears to have the same requirements as the E*SIGN. My question then is we offer stop payments on line. We now require the customer to send in a written request for the stop pay. If we follow 205 ILCS 705/10(c)(1)and since stop pays are governed by state law 801 ILCS 5/4-403(b), can we have a click (I agree) or something similar to replace the written requirement to authorize the stop pay beyond 14 days if we have demonstrable consent, etc? How are any of you handling this?
