Can someone point me to the regulation that says if our risk weighted capital falls below a certain percentage we have to ask for a waiver from the FDIC concerning Nondeposit Investment products? Does this ring a bell with anyone?

I don't recall anything like this. I did a quick search on the FDIC's site for "capital" and "risk based" as it related to NDIPs and didn't get any true hits.

Is this from an audit? If so, maybe the auditor can direct you to a cite. If so - please share!

I have heard of something about if your risk rated capital drops below a certain amount you must obtain approval from the DFI prior to paying cash dividends - or something like that.
