Are members of advisory or development boards considered affiliates under RESPA? For example, we have a potential affiliate board member that is a local realtor. The bank has no ownership in his business and he has no ownership in the bank - he just sits on this advisory/development board. Should he/we be provided AfBA disclosures relevant to this relationship? To take it a step further, what if we have an associate board member who is part owner in a title company - but the bank has no ownership interest in the title company and the title company has no ownership interest in the bank - in fact, the title company is not even a "required provider" - would this be considered an AfBA and require disclosure??
