I'm having problems with a title company that doesn't want to provide us a copy of the seller's CD unless they get the seller’s permission. I know we should have had this on the closing instructions but we didn't.

They are saying that due to privacy issues and everything they have read tells them not to share the CD, not even with the bank. I already sent them part of the Reg, the record keeping requirements and the creditors copy requirement. I also sent them the webinar for 8/2014 where they mention the sellers CD but I have had no luck in making them understand.

Is there some Texas privacy law that they are supposedly following? This seems to be imposed by the Texas Land Title Association. BTW, the “big” banks are not requesting the sellers copy, according to them...

....wonder why they think this is any different than when banks used to get a copy of the Settlement Statement containing all the same data about the seller. Duh.

I guess they think they know more about the Reg than we do; I was told by them that the reason the HUD and TIL were combined was to give the seller a separate disclosure. crazy cry

They must have listened to the same seminar that some of our brokers did. Rumor has it that some title companies are conducting the closing in separate rooms due to privacy concerns.

Tell them to turn over a copy of the seller's disclosure to you or your next stop is the Commissioner's Office of the Texas Department of Insurance and the CFPB.

In addition to that, put them immediately on the "do not do business with" list as your vendor management due diligence process should prohibit you from doing business with vendors that violate Federal law.

The Bank has suffered a substantive violation for every loan that you have closed and not received a copy of the CloD.

What a bunch of idiots.

The real purpose of allowing a separate seller's closing disclosure is to protect the buyer's personal confidential information -- mostly that concerning the loan -- from being disclosed to the seller.
