Myself and another member posted a question regarding the flood monitoring fee. It was included in a conversation and another member posted that it is not to be included in the points & fees test any longer... Can someone please confirm if this is true, when it changed and where it is in the reg? We didn't receive a response from a post end of last month (February).

The flood monitoring fee (w/life of loan) is a fee under 1026.4(a) or (b). As such, this particular fee is excluded from the points and fees test. However, the fee is included in the points and fees test IF the fee is paid directly to the creditor or loan originator( to include broker) or affiliate of either.
