Here in NY we have a tax on homes selling for over one million called a mansion tax. We have it in section E of the CD and have it marked in our system as a prepaid finance charge.
This is the first time I have come across this so I was just looking for others thoughts on if having it as a prepaid finance charge is correct.

Ok, NVM I know it's not included in the APR. (would have paid in a cash deal)

What I still was looking for clarity on was because we overstated the APR, there is no re-disclosure required is there?

The error in APR was caused by an overstatement in the FC. However, you still need to issue a corrected CD at the closing with the correct numbers. This won't cause a delay in closing.

And, if the closing has actually taken place, I'd still recommend a revised CD so the borrower has the correct info.
