We have an issue where the appraiser is requiring an inspection fee that we did not know about at time of the initial LE? Even though this is a 0% tolerance item, can capture this new charge with a CIC and new LE since we were not aware of the charge in the beginning? Or do we eat it since its 0%?

I don't have all of the details yet, but I'm told that some windows were busted out and has since been fixed. I can update as soon as I get all the particulars.

Well, if that was the case, then you have three days to re-disclose the added fee once you knew that an additional inspection was going to be required.

We have a similar situation where the appraisal came back "subject to installation of the AC/heat unit." The originator, knowing there would be an additional final inspection fee, re-disclosed the LE but increased the Appraisal Fee instead of adding a separate line item for "Final Inspection Fee." We realized this now that we are preparing the CD - am I correct in saying that we are out of tolerance since we did not disclose the Final Inspection Fee (something we normally do), or can we still consider this part of the Appraisal Fee?

In-house loan, I would just go with it. Investor loan - check with them.
