I can't find anything in GLBA - Privacy requirements that prohibit sharing information about a loan account to a person who pledges their property as collateral for loan. My reading states that this is not covered in the privacy rules but may be more of a state issue. Would anyone know if Georgia laws would prohibit the disclosing of information? Situation involves mother and son. Mother pledged her car as collateral for a loan. She was not a co-signer or co-applicant. Mom calls the bank and wants to know the status of the account (are payments current?) Son is very upset with the bank because she told them she called and got the information. Appreciate any thoughts.

FINALLY ABOVE the gnat line
O.C.G.A. 7-1-360 governs giving out info in Georgia. I wouldn't consider Mom an account holder if she didn't sign the note. Do your documents -re: hypothecation agreement - give her that right?
