Does Reg E apply to Visa POS transactions?

We have a situation where a Visa POS transaction was returned and the 90 day timeline has lapsed from the date of item return or dispute. We have found that we are not getting the credit back on a transaction that was returned. Are we allowed to debit the customer back this amount even if our timeline has elapsed?

You have to complete your investigation within the time window allowed by Regulation E. Once you have made the provisional credit permanent, you CANNOT go back and debit the customer. If you now have proof that the customer did do the transaction you can only debit them with their permission. Also if you believe the customer pulled one over on you and did make a false claim which will cause you to take a loss, you can always take their debit card away from them to prevent them from doing it again.
