Am I correct in my thinking?

Remotely-captured items, if deposited electronically, are not subject to Reg CC (because they are not deposited at a bank branch). If we produce a substitute check from one of the images, then it would be subject to Reg CC.

Reg E would apply. (ARC & POP) UCC would apply to images if they are not converted to substitute checks.

In my imagination
We are getting ready to roll out our remote deposit capture service and a question came up regarding endorsments. We plan to present the items received via RDC as an electronic image and not as an IRD. Since we are sending the items as an electronic image would we still need to comply with the endorsements standards set forth in Reg CC Appendix D?
