I had thought I read (or heard) somewhere that if an individual signs up for e-statments, goes through the process to demonstrate receipt of the statement, and then later does not "open" any of the statments sent, that after a period of time the account should be changed back to paper statements. Is this true? I can not find a reference anywhere for this.

No, this is not true. The ESIGN "test drive" is a complete substitute for confirmation of receipt. As long as you put the customer through a proper ESIGN opt-in, you do not have to confirm receipt or take any action if you know or suspect that the customer is not receiving or opening the e-delivered documents. (After all, you didn't confirm that customers were opening paper statements.)

If a customer withdraws consent, then you must take whatever action you specified in the account agreement. In some cases, that could be a switch to paper statements and a higher fee.

Under old rules/guidance if it wasn't delivered you had to try redelivery to a different address, but that is gone. So I'm in agreement with Richard's comments above. (And might assume Richard found a wireless connection at the fishing hole, posting during the work day. )
