We currently require customers to enroll in online banking prior to enrolling in e-statements. They can demonstrate their consent to receive electronic statements by accessing a link to PDF of sample statement. We require e-statement enrollment for our rewards account but would like to provide the E-SIGN consent form at account opening. However, we cannot determine how customers would demonstrate their consent prior to enrolling in online banking and consent is required by the E-SIGN Act.

What are other banks who require e-statements doing to demonstrate consent? Do you provide the E-SIGN consent form at account opening?

Any information that you can provide would be greatly appreciated.

If enrolled customers have to go through online banking to pull their e-statements, then a valid demonstration must include navigation of your online banking system, a test pull of a sample statement, and some kind of electronic response proving the previous steps were successful.

If your account opening "ESIGN consent form" is paper, that can cover the preconsent disclosures and contain a service agreement, but you still have to confirm consent in the manner just described.
