When we note in an ad that our bank is "Rated A for Excellent Financial Strength" we always superscript it with a disclaimer that the statement came from "(1)TheStreet.comRatings."

My question is, when 'we' state facts about our bank in an ad, i.e., "$162M in Capital", "Earnings up 26% first six months 2008 over 2007", do we need to also superscript a disclaimer as to where those figures can be found, i.e., "Second Quarter 2008 Call Report." or wherever they may be? Or is having supporting documentation at hand if questioned sufficient ?

Many thanks for advice given.

If you happen to be publicly traded, you might need the securities "Safe Harbor" statement.

Thank you for your advice. We are 'not' publicly traded, so we are OK.
