If we do employ risk based pricing but give the H-3 notice to all home loan applicants and the H-4 to all other consumer applicants, are we in compliance?

Yes, unless the consumer does not have a credit score, then you would need to give H-5.

Keep in mind that these are not generic disclosures. You will undoubtedly have to get your credit bureau provider to provide the information necessary to show the customer's ranking of their credit score amongst the national distributions.
